SEC Investigating Apple Trading
Hey, have some investors been screwing around illegally with the shares of high-flying Apple, Inc., a superstar of the investment scene?
Apparently, the Securities & Exchange Commission is suspicious this may be the case and has kicked off an investigation into the trading in Apple's securities both here and abroad. This is revealed in a series of documents it recently fired off to the brokerage community.
I have obtained copies of those internal SEC documents from a regulatory contact. Interestingly, the nature of its interest shows that the commission is not investigating, as is usually the case, the trading that occurred in a specific time period, but rather, in this instance, in four specific time periods. This suggests the SEC could be looking into more than one potential violation in the trading in Apple shares.
What the agency is seeking in its queries to the brokerage community are the names of its clients who specifically bought and sold Apple's securities in those four time periods and whether anyone did so with a knowledge of non-public, inside information.

Microsoft's fight against Apple ads seen as waste of money
With Apple's Mac home market share tripling in the past five years, Microsoft has fought back with its own advertising campaigns attacking Apple for the first time, a move one analyst sees as a mistake.
In Sunday's New York Times, Devin Leonard took a look at the advertising battle between Apple's "Get a Mac" campaign and Microsoft's "Laptop Hunters" and "I'm a PC" TV spots. He said that the ad war between the two companies is "destined to go down in history," with the likes of the Pepsi-Coca Cola rivalry of the '80s and '90s. But in a new note to investors, Charlie Wolf of Needham & Company said the Mac's recent market share gains are a result of much more than advertising. In addition, he said the Windows maker would be better suited using its money to combat overseas piracy in emerging countries.
"One has to admit that Apple’s 'Get a Mac' campaign was humorous if nothing else," Wolf said. "But why Microsoft responded with an ad campaign of its own is a mystery. The company erroneously attributed the Mac’s share gains to the 'Get a Mac' campaign... However, the damage done to Windows' worldwide market share was miniscule.

Who Bought Hummer
No body knows who bought Hummer. General Motors sold Hummer to mystery buyer just one day after GM filed for bankruptcy. GM says it has entered into a memorandum of understanding to sell Hummer. The deal will preserve HUMMER as global off-road brand and will secure 3000 jobs in the United States. However, General Motors' release has no word as to who bought Hummer. General Motors had said in April (according to CNN) that it was considering three serious offers for Hummer. Reuters report doesn't know who bought Hummer either, but has some more information about bidders who were interested in Hummer in April. According to it, non of the bidders are automakers. One bidder is from USA and the other two are wealthy individuals from overseas.

General Motors reaches deal to sell gas-guzzling SUV Hummer
General Motors says it has completed a deal to sell off its fuel-guzzling SUV Hummer brand. The US manufacturer, which has received tens of billions of dollars in bailout money from the US Government, sought bankruptcy protection yesterday. It says the sale of the Hummer brand will probably save around 3,000 jobs. GM is also trying to sell its Saab and Saturn brands and will phase out Pontiac as it concentrates on the Chevrolet, Cadillac, Buick and GMC marques.

GM Has Buyer for Hummer
DETROIT -- General Motors announced it has signed an agreement to sell Hummer, though it hasn't yet revealed who the buyer is or how much GM will receive for the SUV company. GM said it expects to close the deal by the end of September, pending various approvals. The sale of Hummer will save 3,000 U.S. jobs in manufacturing, engineering and at Hummer dealerships, GM said. The arrangement includes the new buyer contracting vehicle manufacturing and business services during the transition. GM's Shreveport, Louisiana, plant continues to contract assemble the H3 and H3T through at least 2010.

The AOL-Time Warner Saga Bookends One Sorry Decade
The 21st century dawned with news that two media megaliths, AOL and Time Warner, were to merge. Critics howled that the vast tentacles of a combined AOL-TW would subsume us all. Today, Time Warner confirmed it's spinning off AOL, ending a business saga that defined whatever you're calling the 2000s. In retrospect, AOL's deal to acquire — and then be run by — Time Warner marked the end of a century when old media conglomerates were at their peak. The merger, valued at $182 billion when it was announced, was the largest in U.S. history. It is also arguably the most disastrous in history. The combined value of the two companies — both inflated by the dot-com bubble — was $350 billion. Today, before the spin-off goes through, the whole shebang sports a market cap of just under $28 billion.

With no buyers in sight, Time Warner finally to spin off AOL
The marriage between AOL and Time Warner has generally not been a happy one. The original vision was that AOL would provide an outlet for the material that Time Warner's other divisions produced, giving the combined company a whole-widget approach to content. That never worked out, and the division was often a drag on its parent company's earnings. As a result, rumors that AOL was for sale have circulated for years (Ars' coverage of them dates back to at least 2005), and played a prominent role in the awkward ballet performed by Microsoft and Yahoo last year. None of the deals ever came to fruition, and now it appears that Time Warner has given up: AOL will be spun off as an independently traded company. There are still a couple of hurdles the spinoff will have to clear. Google owns a five percent stake in AOL, and Time Warner will have to buy that off the search giant before it can complete the transaction. There will also be a lot of internal bookkeeping maneuvers needed to surgically remove AOL from its parent, and the SEC will have to approve all of them.

Mother's Day can be a huge earning's day for restaurants, especially those best known for serving Sunday brunch. But what happens to those upscale Italian restaurants who definitely aren't recognized for serving killer breakfasts and often are closed on Sundays? That was the dilemma facing my firm and one of my clients.The Back Story One of my clients is among the Northeast's finest Italian Family restaurants beyond the high rises of Boston and New York City. It is known for its hospitality, service and authentic Italian cuisine, using fresh and local produce and humanely raised beef and poultry. In addition, all the seafood comes from local fisheries, and the pastas, breads and desserts are handmade in the kitchen. Mother's Day was approaching, and the restaurant's owners were in a quandary. The restaurant is closed on Sundays, never serves breakfast or brunch, and to maintain quality it would not be able to compete on price. Nevertheless, they had a plan to serve Mother's Day Brunch.

Sensible Incentivizing
Looking at lessons learned from the current economic crisis, one that stands out pertains to how people are incentivized in business. Banks with risky loan portfolios somewhere along the line had incentivized their people to fill their portofolios with these loans. Somewhere along the line, the incentives did not incorporate some of the risks involved. How does this play out in project and program management? Given that projects are of limited duration, it is likely that our team members will come from different parts of the organization and often even from organizations. While we may not have total control over all of the incentives, it is important that we understand what incentives they bring to the project and then what incentives we can use as part of their participation on the project.

FHA Mortgages Makes a New Home Affordable in St. Louis
It has been a long time since I was able to make this statement; if you are currently renting you can buy a new home and not have your monthly mortgage exceed what you are paying in monthly rent. Two factors are contributing to creating a very affordable housing market for first time home buyers, FHA interest rates are at historic lows and the median home prices in St. Louis, St. Charles and Jefferson County continue to go lower. Every month I am doing an ever increasing number of first time home buyer mortgages, in the St. Louis area just under 65% of all homes purchased are first time home buyers utilizing FHA financing. The amazing item that I find in nearly all borrower cases is that the difference between the new house payment and what they were paying in rent is nearly the same, sometimes a bit lower. This includes a house payment for principal, interest, taxes and insurances, the whole enchilada!

FHA Close to Monetizing First Time Homebuyer Tax Credit!
In a video news report by Frank Garay and Brian Stevens of ThinkBigWorkSmall.com, they reported the news that HUD is getting close to allowing the monetization of the First Time Homebuyer Tax Credit. In his prepared remarks, Secretary of HUD, Shaun Donovan, cited an estimate by the National Association of Home Builders that this new tax credit will stimulate 160,000 home sales across the nation - 101,000 of which will be first time buyers who will receive the credit. Another 59,000 existing homeowners will be able to buy another home because a first time buyer purchased their home.
